Terms of service
These terms govern your use of the PrepShot software and this website. By using either, you agree to them.
1. What PrepShot is
PrepShot is software that runs in your web browser and prepares product photographs for online marketplaces. It processes images locally on your own computer. We do not host, receive, store or process your images.
2. Licence
Free tier. You may use the free tier indefinitely, for personal or commercial purposes, subject to the limits described on the pricing page. We do not apply a watermark to anything you produce.
Paid licence. A paid licence grants you a non-exclusive, non-transferable right to use the software without those limits for the term of the licence. It is issued as a signed file containing your name and email address.
You may install your licence on the computers you personally use. You may not share it, publish it, resell it, or distribute it to others. Because the licence identifies you, a shared licence is traceable to you.
What a licence is not. It is not a transfer of ownership. The software, its source and its presets remain ours.
3. Renewal and expiry
Licences run for the term stated at purchase. When a licence expires, the software continues to work at the free tier. It does not stop functioning and you do not lose access to anything you have produced. Files you have already created are yours permanently and unconditionally.
4. Payment and refunds
Prices are shown inclusive of applicable taxes where required. Payment is processed by our payment provider.
Our refund terms are set out on the refunds page and form part of these terms. Nothing in them affects your statutory rights.
5. Acceptable use
You agree not to:
- use the software to process images you do not have the right to process;
- attempt to circumvent the licensing, or help others to;
- redistribute the software as your own product;
- represent the software as affiliated with any marketplace.
6. Marketplace requirements
The software includes presets describing the image requirements of various marketplaces. These are provided as a convenience and are not guaranteed to be current.
Marketplace requirements change without notice. Each preset records the date its values were last verified and links to the platform's own documentation. You are responsible for confirming that the images you upload meet the requirements applying to you at the time you upload them.
We are not affiliated with, endorsed by, or acting on behalf of Amazon, Etsy, Shopify, eBay, Walmart or any other marketplace.
7. No warranty
The software is provided "as is". We do not warrant that it is free of defects, that it will meet your requirements, or that its output will be accepted by any marketplace.
Image processing is complex and outcomes depend on your source photographs. Automated background removal in particular may produce poor results on some subjects, transparent, reflective and finely-detailed objects especially, which is why the software flags results it is unsure about for you to check.
8. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that, our total liability arising out of or in connection with these terms is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect or consequential loss, loss of profit, loss of sales, loss of business, or loss or corruption of data.
Keep your original photographs. The software writes new files; it does not modify your originals. We are not responsible for data you have not backed up.
9. Availability
We aim to keep this website and the software available, but do not guarantee uninterrupted access. Because the software runs locally and can be cached for offline use, an outage on our side does not necessarily prevent you working.
We may discontinue the software. If we do, we will give reasonable notice, and licences already issued will continue to work. They are verified on your own machine and require nothing from us.
10. Changes to these terms
We may update these terms. Material changes will be notified to licence holders by email. Continued use after a change constitutes acceptance.
11. Governing law
The governing law and jurisdiction for these terms have not yet been set. They will be stated here before any paid licence is sold. Nothing in this clause affects the statutory rights applying where you live.
